Terms of Use

1. Agreement and scope

These Terms of Use (“Terms”) are an agreement between you and Yung-Hsin Shieh, the individual developer who operates the BridgeAIWorks brand (“BridgeAIWorks,” “we,” “us,” or “our”), concerning AI Grader Pro Special Edition for macOS (the “App”). By downloading, purchasing, or using the App, you agree to these Terms, the applicable Privacy Policy, the purchase information shown by the Mac App Store, and Apple’s applicable terms. If you do not agree, do not use the App.

These product-specific Terms supplement the BridgeAIWorks Terms of Use. If they conflict, these Terms control for the Special Edition. Mandatory consumer rights and Apple’s required App Store terms continue to apply.

2. License and intended purpose

The App is licensed, not sold. Subject to these Terms and Apple’s usage rules, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, including uses permitted through Apple Family Sharing or volume purchasing where applicable.

The App is a local-first, single-teacher tool for creating assessment materials, reviewing student work, applying educator-defined rubrics, preparing feedback, producing reports, and optionally requesting AI-assisted question generation, grading, or class analysis. It is not a school learning-management system, student-record service, official examination authority, or fully automated decision-making service.

3. Educator eligibility and responsibilities

The Special Edition is intended for adult educators and other professionals who are legally able to enter into these Terms. Google currently requires Gemini API users to be at least 18 years old and to use the service for professional or business purposes. You are responsible for confirming that your use is allowed in your region and under your institution’s rules.

You must have a lawful basis, authority, and any consent required to collect, store, review, export, or send student or third-party information. Before using AI features with student work, you must review the material selected for transmission and remove names, student IDs, or other identifying information when it is not necessary.

You remain solely responsible for grading decisions, academic records, feedback released to students, regulatory or institutional compliance, and the security of exported files. The App does not replace professional judgment, school policy, accessibility obligations, or a required human review process.

4. Local data, backups, and deletion

The App is designed to keep student papers, images, rosters, rubrics, results, corrections, reports, teacher settings, logs, and caches in the App’s local macOS container. BridgeAIWorks does not operate a grading or storage server for the Special Edition and cannot remotely recover local work.

You are responsible for maintaining appropriate backups and protecting access to your Mac. Deleting the App binary alone may not remove all local container or Keychain information. Use the App’s deletion and API-key removal controls before uninstalling when you need those items removed. Deleting local data or uninstalling the App does not cancel an App Store subscription or delete information already processed by a third-party service.

5. Google Gemini API and your API key

AI features require a Google Gemini API key that you provide. Your Special Edition subscription does not include Gemini API access, usage quota, Google Cloud charges, or any other Google fee. You are responsible for your Google account, API key, Cloud project, billing configuration, quotas, and charges.

When you authorize an AI operation, the App sends the selected prompt, rubric, answer, document image, grading context, or class-analysis information directly from your Mac to Google using your API key. BridgeAIWorks does not receive the submitted content, Google’s response, or your API key. Google processes that information under the terms and privacy commitments applicable to your Google account.

You must not submit personal, sensitive, confidential, or student-identifiable information through a Gemini API service that Google treats as an Unpaid Service. If selected material contains such information, you must either remove it, avoid the AI feature, or use a Google Paid Service that provides the legally and institutionally appropriate data treatment. You must also comply with Google’s regional availability, prohibited-use, age, logging, and data-sharing rules.

Keep your API key confidential. If you believe it has been exposed, remove it from the App and revoke or rotate it through Google. Removing a key prevents future App requests with that key but does not cancel Google billing or delete information retained by Google.

6. AI output and human review

AI-generated questions, scores, classifications, explanations, comments, and analyses may be incomplete, inconsistent, biased, or incorrect. They are suggestions for educator review, not final academic decisions. You must check the source work, rubric, calculations, citations, and proposed feedback before relying on, recording, or sharing an output.

You must not use the App to make a decision that has a legal or similarly significant effect on a student without the review, explanation, appeal process, and other safeguards required by applicable law and institutional policy.

7. Mac App Store subscriptions and purchases

The App may offer auto-renewable subscriptions through the Mac App Store. The subscription name, duration, price, currency, included features, and any trial or introductory offer are the details shown in the App and Apple’s purchase sheet at the time you confirm the transaction.

Payment is charged to your Apple Account. Unless cancelled, an auto-renewable subscription renews through Apple according to the subscription period and price disclosed by Apple. You can view, manage, restore, or cancel through your Apple Account or the App Store subscription settings. Deleting the App, deleting local data, or removing a Gemini API key does not cancel the subscription.

Cancellation affects future renewals and ordinarily leaves access available through the already-paid period, subject to Apple’s rules. Refund eligibility is determined by Apple’s policies and applicable consumer law. BridgeAIWorks does not receive your payment-card information and cannot change or cancel an App Store transaction on your behalf.

Store availability, subscription verification, purchase restoration, and entitlement updates depend on Apple services, your Apple Account, network availability, and valid transaction information. Temporary verification failures may delay access to subscription features.

8. Your content and intellectual property

You retain any rights you hold in exams, rubrics, student work, grading records, reports, and other content you enter or create. You are responsible for having the rights necessary to use that content. These Terms do not transfer ownership of student or educator content to BridgeAIWorks.

BridgeAIWorks and its licensors retain rights in the App, software, interface, branding, documentation, bundled assets, and related materials. Except where law permits otherwise, you may not copy, distribute, sell, sublicense, rent, defeat access controls, or reverse engineer the App.

9. Acceptable use

You may not use the App or connected AI services to violate law, academic-integrity rules, privacy or intellectual-property rights, provider policies, or another person’s rights. You may not introduce malicious code, interfere with security or subscription verification, obtain unauthorized access, share an API key without authorization, or use the App to generate deceptive, abusive, discriminatory, or harmful decisions.

10. Third-party services

Apple operates the Mac App Store, Apple Account, payment, subscription, and StoreKit services. Google operates the Gemini API, Google Cloud, billing, logging, and related account services. Those services are governed by their own agreements and privacy practices, may change independently, and may be unavailable in some regions.

Review the current Apple Standard EULA, Gemini API Additional Terms, and Gemini API data logging and sharing documentation. You must comply with applicable third-party terms while using the App.

11. Updates, compatibility, and service changes

We may update the App to correct defects, improve security, maintain compatibility, or change features. Compatibility can depend on macOS, device capabilities, Apple services, third-party APIs, and provider model availability. We do not guarantee that every feature, model, file, or output will remain available indefinitely.

12. Warranty disclaimer and limitation of liability

The App and AI-assisted output are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability. Nothing in these Terms excludes a warranty or consumer right that applicable law does not allow to be excluded.

To the maximum extent permitted by law, BridgeAIWorks and the operator are not liable for indirect, incidental, special, consequential, or similar loss arising from use of or inability to use the App, including loss of local data, grading errors, missed deadlines, academic disputes, third-party charges, or provider outages. This limitation does not apply where liability cannot legally be excluded or limited.

13. Suspension and termination

You may stop using the App at any time. Your App Store subscription must be cancelled separately if you do not want it to renew. We may suspend or terminate access where reasonably necessary to address unlawful use, material breach, fraud, security threats, or App Store requirements. Provisions concerning ownership, responsibility for submitted content, disclaimers, liability, and third-party obligations survive termination where their nature requires.

14. Apple App Store terms

These Terms are product-specific supplemental terms and do not replace Apple’s Licensed Application End User License Agreement (Standard EULA). The Standard EULA applies to the App unless Apple displays an approved custom EULA. Apple is not responsible for providing support for this third-party App; BridgeAIWorks provides App support, subject to applicable law.

If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price where required by the Standard EULA. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Apple and its subsidiaries are third-party beneficiaries of the Standard EULA and may enforce it as provided there.

15. Changes to these Terms

We may update these Terms when the App, law, store requirements, or connected services change. The effective date identifies the current version. If a material change requires additional notice or consent, we will provide it through an appropriate channel before the change takes effect where required.
